End User License Agreement (EULA) for Entiendo

This End User License Agreement ("EULA") is a legal agreement between you ("User") and Entiendo ("App Provider") for the use of the Entiendo instant messaging app ("App"). By installing, accessing, or using the App, you agree to be bound by the terms and conditions of this EULA. If you do not agree to these terms, you may not use the App.

1. License: Subject to the terms and conditions of this EULA, App Provider grants User a non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial use on a single device that User owns or controls.
2. Intellectual Property: The App, including but not limited to its design, features, functionality, content, and any updates or enhancements, are the intellectual property of App Provider and are protected by copyright, trademark, and other laws. User acknowledges that no ownership or rights in the App are transferred to User under this EULA.
3. User Obligations: User agrees to use the App in compliance with all applicable laws and regulations, and not to use the App for any illegal, unauthorized, or prohibited purposes. User is solely responsible for the content of any messages or communications sent or received through the App. User must not use the App to send or receive any offensive, discriminatory, or harmful content.
4. Privacy: The App may collect and use User's personal information as described in the App's Privacy Policy. User acknowledges and agrees that App Provider may collect, use, store, and disclose User's personal information in accordance with the Privacy Policy.
5. Updates and Support: App Provider may release updates or enhancements to the App from time to time. User agrees to install and use the latest version of the App to ensure continued functionality. App Provider may also provide support for the App, but is not obligated to do so.
6. Termination: This EULA is effective until terminated by either User or App Provider. User may terminate this EULA by deleting the App from User's device. App Provider may terminate this EULA at any time without notice, and may also terminate User's access to the App if User breaches any terms of this EULA.
7. Disclaimers and Limitations of Liability: THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. APP PROVIDER DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. APP PROVIDER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH THIS EULA OR THE USE OR INABILITY TO USE THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, BUSINESS INTERRUPTION, OR LOSS OF PROFITS.
8. Entire Agreement and Severability: This EULA constitutes the entire agreement between User and App Provider with respect to the subject matter hereof and supersedes all prior or contemporaneous understandings or agreements, whether oral or written. If any provision of this EULA is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
9. Amendments: App Provider may modify this EULA at any time by posting the updated version in the App or providing notice to User by email. User's continued use of the App after any such modifications constitutes
10. Miscellaneous: This EULA does not create any partnership, joint venture, agency, or employment relationship between User and App Provider. User may not assign, transfer, or sublicense any rights or obligations under this EULA without the prior written consent of App Provider. App Provider may assign, transfer, or delegate any rights or obligations under this EULA without User's consent. The failure of App Provider to enforce any provision of this EULA shall not be construed as a waiver of such provision or the right to enforce it thereafter.

By installing, accessing, or using the App, User acknowledges that User has read, understood, and agreed to be bound by the terms and conditions of this EULA. If User does not agree to these terms, User must not use the App.
